What is a mechanic's lein?

A mechanic’s lien is a legal claim against a vehicle for unpaid charges. The lien process is administered by the Maryland Motor Vehicle Administration (MVA).

Who can file a mechanic's lein?

If you repaired, rebuilt, towed, or stored a vehicle and were not paid, you may file a Mechanic’s Lien under Maryland law.

You must have clear documentation of the work performed and the amount owed.

How to file a mechanic's lein

If you'd like to file a mechanic's lein, follow these steps. Failure to follow required procedures may result in denial of your lien.

Step 1: Send written notice

Send written notice to the vehicle owner and any recorded lienholder. The notice must include:

• Your business name and contact information
• A description of the vehicle (year, make, model, VIN)
• The total amount owed
• The reason for the charges

Notice must be sent within the timeframe required by law.

Keep proof of mailing (such as certified mail documentation). Proof of notice is required when submitting your application.

Step 2: Gather required documents

You must submit:

• A completed mechanic’s lien application
• Proof that proper notice was sent
• An itemized invoice or billing record
• Vehicle information (including VIN)
• The required filing fee

All information must be accurate and consistent across documents.

Step 3: Submit the application, supporting documents & fee 

Submit all materials to the MVA.

All filings must comply with the Maryland Transportation Article and other applicable statutes. You are responsible for meeting all statutory requirements.

Fees are non-refundable.

What to expect after you apply

The MVA will review your application to confirm:

• Proper notice requirements were met
• Documentation is complete
• Statutory conditions have been satisfied

If the application does not meet legal requirements, it may be denied.

If the lein is approved

If approved, the lien will be recorded against the vehicle in accordance with Maryland law.

Once recorded:

• The vehicle may not be transferred without addressing the lien
• Additional legal procedures may apply before enforcement or sale
• You must comply with all statutory requirements governing lien enforcement
